Misleading ad: Delhi High Court issues notice to Patanjali Ayurveda and Baba Ramdev on plea alleging non-vegetarian ingredient in herbal tooth powder

The Delhi High Court on Friday issued notice to Patanjali Ayurveda, Baba Ramdev, and the Central government on a petition alleging that its herbal tooth powder contained a non-vegetarian ingredient and has been misbranded as vegetarian.

The single-judge Bench of Justice Sanjeev Narula also issued notice Divya Pharmacy, which manufactures Patanjali’s herbal tooth powder, Divya Dant Manjan.

The High Court listed the matter for further hearing on November 28.

Filed by Advocate Yatin Sharma, the petition alleged that the packaging of Patanjali’s Divya Dant Manjan had a distinctive green dot, a symbol notifying vegetarian products. However, the list of ingredients on the packaging clearly showed that the tooth powder contained Sepia officinalis (common cuttlefish).

The petitioner argued that this amounted to misbranding, adding that Baba Ramdev and others were also promoting the product as vegetarian.

The petition further submitted that this violated the Drugs and Cosmetics Act.
