Allahabad High Court directs woman to pay 25% of her mother’s hospital expenses

The Allahabad High Court has directed a woman to pay at least 25% of the current outstanding medical expenses of her hospitalised mother.

A Single Bench of Justice Saurabh Shyam Shamshery passed this order while hearing an application under section 482 filed by Sangeeta Kumari.

The Court has passed following order on 14.08.2024 :-

“Prem Sagar Verma, counsel for applicant submitted that he is not pressing the application on merit and that since the opposite party No 2 is her mother, therefore, there is possibility of settlement.

In the aforesaid circumstances, let notice be issued to opposite party No 2 returnable at an early date.

Dasti in addition.

Steps will be taken within seven days.

List on the date fixed in the notice at 3.30 p.m.

Meanwhile, in case, applicant deposits Rs 50,000 within one week before the Trial Court, no coercive measures shall be taken against her. Registrar (Compliance) to take steps.”

Counsel for the complainant submitted that complainant is presently admitted in Ispat Hospital, Bhatha Road, Gosaintola, Ranchi, South Chota Nagpur Division, Jharkhand and her residential address is Krishnapuri, Chutia, Ranchi.

Counsel for the applicant, on instructions, submitted that the applicant will visit her mother at hospital within a week and she will try to meet her as a mother and not as an opponent.

The Court is hopeful that on the next day the applicant as well as complainant will communicate to the Court through their advocate about the nature of the meeting.

“Meanwhile, the applicant will also come forward to discharge her part of responsibility towards her mother and will pay at least 25% of outstanding amount (as on today) of medical expenses incurred on her mother who is admitted in aforesaid hospital”, the order reads.

The Court advised both parties to follow:

“‘Matru Devo Bhava’ (Mother is equal to God) and ‘Kshama Badan ko Chahiye, chotan ko utpat, mischief of the younger.’ (Forgiveness suits the elderly and mischief suits the younger ones. That is if the younger ones misbehave, it is not a big deal and the elders should forgive them for this.)”
