Chhattisgarh High Court seeks CMO affidavit in suo motu medical negligence case

The Chhattisgarh High Court heard a Suo Motu public interest litigation following a news report alleging medical negligence at Bilaspur’s District Hospital. 

The report claimed a doctor refused treatment to a critically injured patient.

The court directed the Chief Medical Officer to file a personal affidavit. 

The Civil Surgeon’s submitted affidavit clarified that the injured patient received primary treatment and was referred to Chhattisgarh Institute of Medical Science (CIMS) for further care. 

However, his relatives insisted on taking him to a private hospital.

The affidavit also stated that the injured patient was intoxicated and semiconscious, and two other patients with stab wounds and chest pain were being treated simultaneously.

The Division Bench of Chief Justice Ramesh Sinha and Justice Bibhu Datta Guru reviewed the affidavit and supporting documents, including CCTV footage, medical records, and police reports. 

It concluded that the allegations of medical negligence were unfounded.

The matter was consigned to record, indicating no further action would be taken.
