SC unhappy over non-appointment of Lokpal, asks Centre to file fresh affidavit in 4 weeks

On Wednesday (January 17) amicus Gopal Subramaniyam agreed with petitioner NGO Lok Prahari’s view that section 4 of the Uttar Pradesh Ministers (Salaries, Allowances and Miscellaneous Provisions) (Amendment Act), 2016 could be invalid being ultra vires.

At this, the Supreme Court bench of Justices Ranjan Gogoi and R Banumathi asked law officers of union and states which have implemented such provision to be present before the court on the next date.

The petitioner says that the section in question is invalid being ultra vires, unconstitutional and against the scope and ambit of original Act in terms of the law laid down by the Apex Court in this regard.

The court also said that the copy of the order is to be supplied to the Attorney General, the Additional Solicitor General and the Advocates General of the states.

The next date of hearing has been set for March 13.
