The Supreme Court on Wednesday (May 16) dismissed the bail plea of ex-UP minister Gayatri Prajapati on the grounds that the prosecutrix has not been examined till now, while also directing the trial court to expedite the proceedings of the case and if need be take the case on day-to-day basis.

The bench of Justices A K Sikri and Ashok Bhushan also dismissed the bail application of Ashok Tiwari saying that this was not mentioned before the high court.

The petitioner had argued that charge-sheet was filed and charges were framed on the basis of that. And the cognizance of the matter was taken up from case diary. “Trial court says it is on the basis of case diary but the high court says it is based on charge sheet.”

To which the bench said: “Face the trial.”
