Delhi HC seeks replies from RBI, Google India for giving authorization to Google Pay

Delhi HC on Wednesday issued notice to RBI and Google India seeking their response on PIL alleging Google Pay App operating in India without proper authorization from Reserve Bank of India (RBI).

Acting upon a plea, a bench led by Chief Justice Rajender Menon and Justice A J Bhambhani asked RBI why Google Pay App was operating without a requisite authorisation.

Petitioner contended that Google India Digital Services Private Limited was doing business as Google Pay that is unauthorised in India as it contravenes Payment and Settlement Systems in defiance of the Section 4 sub section 1 of the Payment and Settlement Systems Act, 2007. The said section clearly mentions that no person, other than the Reserve Bank, system not shall commence or operate a payment system except to operate under and in accordance with an authorization issued without by the RBI.

He said, Google India Digital Services Private Limited doing business as Google Pay is not listed as an authorised operator as per list of the ‘Payment System Operators’ authorised by the RBI to set up and operate in India under the Payment and Settlement Systems Act, 2007 as published by the RBI dated March 20, 2019.

He further stated in PIL that the Google India Digital Services Private Limited doing business as Google Pay though its unauthorised operation in India as Payment and Settlement Systems has unmonitored and unauthorised access to the personal information such as AADHAR, PAN, Transaction etc. of the public by acting as a Payment and Settlement Systems.
