SC asks Congress MP to file fresh plea against EC Clean Chit To Modi, Shah

The Supreme Court on Wednesday  dismissed a petition filed by Congress MP Sushmita Dev seeking action against PM Narendra Modi and BJP Amit Shah for their comments made during the election campaign. The MP from Assam had petitioned the apex court to issue a direction to the Election Commission of India to take action against the BJP leaders.

The Congress petition had objected to EC giving clean chit to the BJP leaders against allegations filed against them, and had asked that SC should order EC to revise its decision. But the Supreme Court said that if the petitioner wants to challenge the decision of EC, then a separate independent petition will have to be filed.

Dev, who is the president of the Congress Women’s cell had filed the petition in the apex court seeking that the po9ll panel  be directedto expedite the complaints against the BJP leaders. It was her contention that the EC was sitting on charges against Modi and Shah.

The bench of Chief Justice Ranjan Gogoi and justice Deepak Gupta said that the original plea was for the disposal of complaints against Modi and Shah, and the EC has already concluded. The bench also noted that the orders of the EC were not challenged in the additional affidavit. As the request of the original petition was already fulfilled, the petition had become infructuous or pointless, hence the same was disposed of by the court.
