A Delhi High Court bench comprising Chief Justice Rajendra Menon and Justice Brijesh Sethi directed the North Delhi Municipal Corporation and East Delhi Municipal Corporation to disburse salary to its doctors, teachers and other employees as per the service contract. The plea was filed by Advocate Ashok Agarwal.
The petition mentioned that the primary teachers working with North and East Delhi Municipal Corporation were not paid salaries regularly resulting in the violation of their fundamental rights guaranteed under Article 21 of the Indian Constitution. The study of students was also affected due to the non-payment of salaries which violates the mandate of RTE Act, 2009.
The petitioner also highlighted that, as many as 1000 doctors including Residential Doctors working in North Delhi Municipal Corporation run hospitals have not been paid salary for the months of March and April 2019 till date. Due to tax deduction, teachers in North Delhi Municipal Corporation schools were paid only a small amount of salary for February 2019.
The petition mentioned that,
“Mental Agony and harassment is quite natural among such teachers. Needless to say that most of these teachers have no money to pay school fee of their children.”
The court directed the municipal corporation to file their reply alone with monthly compliance report in regards to the payment made to its employees.
The court will hear the matter next on 05 July, 2019.
