SC to hear tomorrow plea against EC decision to hold two separate bypolls for two RS seats

The Supreme Court will hear tomorrow plea challenging the decision of Election Commission (EC) to hold two separate bypolls for two Rajya Sabha seats in Gujarat.

The plea filed by Gujarat Congress leader Pareshbhai Dhanani was mentioned today for urgent hearing before the bench comprising Justices Deepak Gupta and Surya Kant contending that EC has already slated the elections for two seats on July 5.

The two seats on which elections are scheduled were fell vacant after the incumbent MPs from the seats —Smriti Irani and Amit Shah— became Lok Sabha MPs. Shah was appointed Union Home Minister and Irani was named the Minister of Women and Child Development.

The plea contented that separate bypolls would disturb the procedure of proportional representation as stipulated under the Representation of People’s Act (RPA), 1951.
