No relief for the rape accused from the Apex Court

The Hon’ble Apex Court on Friday dismisses the SLP (Special Leave Petition) filed by the Abdul Sami, a rape accused by upholding the Hon’ble Allahabad High Court Judgment dated 16.09.2019.

The Bench of Justice NV Ramana and Justice Sanjiv Khanna finds no good ground for allowing the SLP filed by the Petitioner, Abdul Sami involved in Case Crime No.164 of 2019 under Sections 498-A, 323, 506, 342, 376, 377 and 313 I.P.C., Police Station Mirapur, District Ballia, Uttar Pradesh.

Learned Counsel arguing for Abdul Sami told the Supreme Court that accused is brother-in-law (Dewar) of the first informant, the victim in the case. The allegations of commission of rape by the accused apparently appear to be palpably false and frivolous.

On the other hand, Learned Counsel appearing on behalf of the State of Uttar Pradesh contended that there is specific allegation of consistent commission of rape on the prosecutrix by the accused who has also used force in the commission of crime.

The Apex Court has discovered nothing in support of the accused for allowing the SLP and dismissed the same.
