Tis Hazari clash updates: Court issues notice to Bar Council Of India, & more

Delhi High Court on Tuesday issued notices to Bar Council of India, Delhi High Court Bar Association and all the district Bar Associations of Delhi on the clarification sought by the Ministry of Home Affairs in the Sunday order by the High Court in Tis Hazari lawyer-police clash.

Besides ordering judicial probe in the Tis Hazari clash, an ex-gratia amount to the three injured lawyers was also directed. Court also ordered suspension of police officials who fired gun and dealt lathi blows to lawyers. Court had further ordered that no coercive action be taken against the lawyers in the FIR lodged on November 2.

The MHA, on notice of court order on Sunday, sought clarification with the court yesterday, stating that the court’s order of no coercive action on lawyers should be applicable only to the lawyer-police clash on Saturday and not extended to the aggression by lawyers on Monday in Karkardooma and Saket courts.

After Monday’s incident, police personnel too went on strike. In its wake, the Central IPS Association has demanded cancellation of licence of the lawyers who manhandled police personnel and civilians. In its statement, the Association has said, “Police Personnel are entitled to the same human rights as anyone else in the country… The Courts should treat all parties equitably and grant justice.”

An FIR has been lodged in Saket police station against the advocates.

Earlier yesterday, Delhi Police submitted a report to the Union Home Ministry on the clash that ensued on Saturday at Tis Hazari Courts and action taken where several advocates and police personnel were injured. It however did not state the attack on police personnel on Monday that happened in Saket court.

The Bar Council of India too put out a statement urging the bar associations to recall their resolutions of strike saying, “Bar Council cannot tolerate Hooliganism.”

The District Bar Associations of Delhi had passed resolutions of strike after November 2 clash.

BCI Chairman Manan Mishra, in the letter, explained that police would use every action of individual lawyers against the collective which would harm the inquiry and their case.

Mr. Mishra has urged the lawyers to stop violence and to bring to books the rowdy lawyers.
