The Uttarakhand High Court on Friday directed the Government Medical College to issue NOC for counselling in NEET PG in Non-Clinical or Para Clinical courses.
The grievance of the petitioner was that the petitioner was issued with an NOC by the College but that was confined for being an NOC to appear in clinical discipline only and in pursuance to the information bulletin, the counselling for the aforesaid NEET PG course is to be commenced and as a consequence of the NOC which is already granted to the petitioner, he would only be permitted to take the counselling for clinical courses.
The petitioner’s counsel said that the said restriction imposed in the NOC by Medical College, is arbitrary as it limits the choice of course for the petitioner to participate in the counselling for para medical and non-medical courses, which too carries the same basic essential qualification i.e. M.B.B.S from recognized medical colleges in the State.
In pursuance to issuance of the bulletin by National Board for Examination of NEET PG 2020, the petitioner applied and took his examination and ultimately the result was declared and he ranked 59582 on all India basis.
As per the Public Notice issued by Medical Council of India, the counselling for the NEET PG 2020 in relation to the Government Medical Colleges as well as that of private Medical Colleges, the candidates were supposed to apply for counselling between 18.04.2020 to 25.04.2020.
Acting upon the plea, the single judge bench of Justice Sharad Kumar Sharma held that the permission which has been granted, by virtue of an interim order as being rendered today by way of a direction to the respondent to issue NOC to the petitioner, so as to enable him to participate in NEET PG 2020 counselling for non-clinical as well as para clinical which is subject to the condition that the said permission would be exclusively provisional in nature and that will depend upon the final adjudication of the writ petition.
The Court also directed that in the meantime, the respondents may file their counter affidavits within the period of three weeks from date of the order and directed to list the case after three weeks.
