The Delhi High Court on Tuesday has directed District & Sessions Judge, North-East Delhi to ensure that the application, if any, filed by the accused Shahrukh of Delhi riots, seeking grant of bail is taken up for hearing within two days of it being filed.
Acting upon the plea, the single judge bench of Justice Anu Malhotra was hearing the bail application filed by Shahrukh Pathan who is in judicial custody in the matter of allegedly opening fire on the Police Officer, during the Delhi Riots in CAA Protests on 24th February 2020.
Pathan has been charged under FIR No.51/2020, P.S. Jaffarabad, under Sections 186/307/353 of the Indian Penal Code, 1860 and Sections 25 & 27 of the Arms Act.
The Counsel appearing for Pathan submitted that an application has been filed seeking grant of bail before the Sessions Court but was not taken up for hearing observing to the effect that there is no urgency in the matter.
Further, he sought a direction to withdraw the present application seeking liberty to seek redressal before the Sessions Court.
Whereas, the Court directed the District & Sessions Judge, North-East to ensure that the application, if any, filed by the applicant seeking grant of bail is taken up for hearing within two days of it being filed.
The court further dismissed the application as withdrawn and granted the liberty to the petitioner to seek a remedy before the Sessions Court.
