Lawyers Need To Engage With SC Judges For Post Lockdown Court Functioning: Ex SCBA Chief Vikas Singh

Amid the infighting going on between President of SCBA Dushyant Dave and Ashok Arora former secretary SCBA which has tarnished the image of the lawyers’ body, Mr. Vikas Singh, Senior Advocate and former President of bar has expressed his anguish over the tussle and affairs of the Supreme Court Bar Association.

Mr. Singh in his letter written on Saturday to Executive Members said that there can never be a call for an emergent general meeting (EGM) to remove any elected office bearer within the term of the year for which he/she is elected merely because some members feel that the office bearer would be removed. He also said that it was completely improper on part of the secretary to call for the EGM for the said purpose.

Ashok Arora was suspended from the position of Secretary in a resolution passed on May 8. The decision was taken by way of majority and President Dushyant Dave had abstained from voting on the same. Mr. Singh on removal of Ashok Arora said that if the general body is not empowered to remove an office bearer duly elected at the AGM, the EC definitely cannot have the authority to remove from office unless there are accusations of moral turpitude of financial bungling.

Mr. Vikas Singh apart from the infighting also highlighted the manner in which the SCBA has decided to help the needy advocates amid nationwide lockdown. He said the funds should not have been disbursed as a way of loan to these members with a threat of termination of membership if the loan is not repaid rather the SCBA should have used the money to tide over the financial crisis of the needy members of the bar.

Mr. Singh while concluding has highlighted that the important issue confronting the SCBA is regard to functioning of Supreme Court post lockdown. He stressed that the lawyers need to engage with the Judges to work out and arrangement during the subsistence of pandemic COVID-19.
