The Delhi High Court asked the Central government and the Delhi government to decide on a plea to link property documents with Aadhaar within three months.
A Division Bench comprising Justices Rajiv Shakdher and Justice Girish Kathpalia on Thursday directed the government to treat BJP leader Ashwini Upadhyay’s Public Interest Litigation (PIL) as a representation and disposed of the plea.
The Delhi High Court stated that the Aadhaar card and property document link is an issue which is best left to the government. The Court underlined that the government will have to study and see the cross and benefits of the same. The Bench also noted that if necessary then the authorities can also take assistance from BJP leader Ashwini Upadhyay as well.
The BJP leader had approached the Delhi High Court contending that linking Aadhaar with property documents would curb corruption, black money and other illegal transactions. He said that the government is duty bound to take measures to control corruption and seize illegal properties in order to secure the goals under Article 21 of the Constitution.
In his Public Interest Litigation, Ashwini Upadhyay submitted that linking movable-immovable properties with the owner’s Aadhaar number could be an answer to curb the menace. The plea underlined that the black money holders would be forced to declare their unaudited movable and immovable properties and that it will take years to generate that amount of illegal properties again. It further mentioned that in the long run it will help in putting an end to the black money generation.
The BJP Leader further asserted that if the government made it mandatory to link property documents with Aadhaar, it would lead to an increment of 2 percent in the annual growth. The plea also mentioned that linking Aadhaar with property documents will clean the electoral process, which is dominated by black-money and illegal transactions.
