Allahabad HC summons Hathras district panchayat member, his wife for their separate habeas corpus pleas

The Allahabad High Court on Wednesday ordered Hathras District Panchayat member Manoj Kumar and his wife Rajni to be produced before the Court on July 2. 

Justice Ajit Kumar passed this order while hearing a Habeas Corpus petition filed by Manoj Kumar and Another.

The Habeas Corpus petition has been filed with allegation that the husband of the petitioner no.2 (Rajni) is in illegal confinement of respondents.

G.S.Chaturvedi, Senior Advocate, submitted that Manoj Kumar has already filed a Habeas Corpus Petition on behalf of his wife Rajni, the Petitioner no.2, against illegal confinement of his wife by one Jaswant Singh and his aides.

The rival submissions have come up and the motive attached is that both sides want Manoj Kumar to vote in favour of their respective candidates in the scheduled voting of the election of the president of Zila Panchayat on July 3, 2021, the Court said.

Chaturvedi has further submitted that the petition though has been given filing number but he is not sure as to when that petition would come up. The filing number of the said Habeas Corpus Petition presented with the Stamp Reporter/Registry on June 25, 2021 is 56858 of 2021.

“Put up the case along with the other Habeas Corpus Petition filed by Manoj Kumar on behalf of his wife, on July 2, 2021 at 10 AM on which date both the Petitioners of the respective Petitions, namely, Rajni and Manoj Kumar shall appear before the Registrar General in the first instance and Registrar General shall ensure their presence in Court complying with Covid protocol. No one else including Counsel for the respective parties shall be permitted for physical appearance in Court. Counsel appearing for both the parties have agreed that they will be able to produce the Petitioners before Registrar General by the next date fixed,” the order reads.
