Allahabad High Court stays Agra Transport Officer order prohibiting registration of new e-rickshaws

The Allahabad High Court has stayed the order dated 8.1.2024 issued by the Assistant Regional Transport Officer (Administration), Agra in exercise of powers conferred by Rule 178 of the U.P Motor Vehicles Rules, 1998. By the notification, registration of new e-rickshaws/e-autos has been prohibited after 10.1.2024/27.1.2024.

The Division Bench of Justice Anjani Kumar Mishra Justice Jayant Banerji passed this order while hearing a petition filed by Agra E- Vahan Vyapar Association through Its Vice President Sung Priya Gautam.

The contention of counsel for the petitioner is that Rule 178 referred to above, confers power upon the Superintendent of Police or Registering Authority to issue directions restricting the speed of or restricting or prohibiting the use of motor vehicles generally or of any particular class or classes of motor vehicles in any area or any road. This rule does not, therefore, provide the power to the aforesaid authorities to restrict registration of vehicles.

The Court observed that the matter requires consideration.

The Court granted three weeks time to file counter affidavit for the respondents and one week time to file rejoinder affidavit.

“Connect with Writ-A No 69 of 2024 and list on the date fixed.

Until further orders of the Court, the effect and operation of the impugned order dated 8.1.2024 shall remain stayed”, the Court ordered.
