The Lucknow Bench of the Allahabad High Court has allowed the bail application of a minor accused of posting comments against Goddess Durga on his Facebook Account.
A Single Bench of Justice Subhash Vidyarthi passed this order while hearing a Criminal Misc Bail Application filed by a minor.
By means of the application the applicant seeks bail in Case under Sections 298, 505(i)(c), I.P.C, and Section 67, Information Technology Act, P.S Pura Kalandar, District Faizabad.
The aforesaid case has been registered on the basis of an F.I.R lodged on 27.09.2022, stating that the applicant was posting comments against a Goddess on his Facebook Account.
A supplementary-affidavit has been filed on behalf of the applicant annexing therewith a photocopy of his High School Certificate-cum-Marksheet, which mentions his date of birth to be 07.01.2006 and a copy of his Adhar-card, wherein the same date of birth is mentioned.
From the Aadhar-card and High School Marks-sheet of the applicant, it clearly appears that the applicant is a minor and yet he is languishing in jail since 27.09.2022., the Court observed while allowing the bail application.
“Let the applicant be released on bail in the aforesaid Case under Sections 298, 505(i)(c), I.P.C, and Section 67, Information Technology Act, P.S Pura Kalandar, District Faizabad, on submission of a personal bond and two sureties, each in the like amount, by his guardian, to the satisfaction of Magistrate/Court concerned”, the Court ordered.
