The Allahabad High Court has directed the Principal, Jawahar Navodaya Vidyalaya, Barua Sagar, Jhansi to take a decision within two weeks on granting admission to the successful candidate in Class 6.
A single-judge bench of Justice Manju Rani Chauhan passed this order while hearing a petition filed by Ankit Kumar (Minor).
The petition has been filed by the petitioner with a prayer to direct the respondents to grant admission of the petitioner on the basis of Selection List-2021 (Class 6), under the Provision of Right of Children to Free and Compulsory Education Act at Jawahar Navodaya Vidyalaya, Barua Sagar, Jhansi.
Counsel for the petitioner submitted that the petitioner submitted online admission form for admission in Class 6 in Jawahar Navodaya Vidyalaya, Barua Sagar, Jhansi and appeared in the examination on August 11, 2021 and was provisionally selected, however, admission has not been given to the petitioner till date. Hence, the petition has been filed.
Counsel for the respondents submitted that in case, the petitioner moves an application in this regard before the respondents, the same will be considered by the respondents in accordance with law.
Counsel for the parties agree that the writ petition may be disposed of finally at this stage without calling for a counter-affidavit specifically in view of the order proposed to be passed, the Court said.
Considering the facts and circumstances of the case, without expressing any opinion on the merits of the case, the Court disposed the writ petition with a direction to the petitioner to make a representation before respondents ventilating all his grievances, within one week along with a certified copy of the order and, if any such representation is made, the Principal, Jawahar Navodaya Vidyalaya, Barua Sagar, District-Jhansi, shall make all endeavours to consider and decide the same expeditiously, in accordance with law, preferably within a period of two weeks from the date of receipt of the said representation.
