Allahabad High Court directs local bodies to pay revised pension to retired pensioners and families

The Allahabad High Court has directed the local bodies to pay revised pension to retired pensioners and family pensioners before January 1, 2016.

A Single Bench of Justice J.J Munir passed this order while hearing a petition filed by Yogesh Chandra Joshi.

Girijesh Kumar Tripathi, the Additional Chief Standing Counsel has brought to the notice of the Court a Government Order dated 11.12.2023, which satisfies the petitioner’s claim regarding revision of pension with effect from 01.01.2016 in terms of the Government order dated 18.07.2017 passed by the Central Government.

The Court directed the General Manager, Jal Kal Vibhag, Nagar Nigam, Prayagraj to revise the petitioner’s pension in accordance with the Government Order dated 11.12.2023 issued by the Principal Secretary in the Department of Local Bodies, Government of U.P, within two weeks.

The Court further directed the Director, Local Bodies, Government of U.P., Lucknow to take necessary steps within two weeks and ensure that the petitioner’s pension is revised by the General Manager, Jal Kal Vibhag, Nagar Nigam, Prayagraj in terms of the Government order dated 11.12.2023.

If by that date, the petitioner’s pension is not revised, the General Manager, Jal Kal Vibhag, Nagar Nigam, Prayagraj shall appear in person on the date fixed. However, in case the petitioner’s pension is revised, the Officer need not appear.

At this stage, S.D Kautilya, Counsel appearing for the Nagar Nigam, Prayagraj has contended that the General Manager, Jal Kal Vibhag, Nagar Nigam, Prayagraj is not in a position to revise the petitioner’s pension, unless he receives an order from the Director.

The General Manager, Jal Kal Vibhag, Nagar Nigam, Prayagraj has been ordered by the Court to revise the petitioner’s pension, in accordance with the Government Order already issued, and, any delay on his part will be regarded as disobedience to the order of the Court, the Court said.

The Court has fixed the next hearing of the petition on January 10, 2024.
