The Allahabad High Court has directed the regional manager of the State Road Transport Corporation (Roadways) to dispose of the claim of retirement benefits of the wife of a dismissed deceased employee of the corporation within four weeks.
A Single Bench of Justice Neeraj Tiwari passed this order while hearing a petition filed by Shaheen Fatma.
The petition has been filed seeking following relief:-
“(1) Issue a writ, order or direction in the nature of Mandamus directing the respondents to pay the petitioner all the retiral dues and benefit with interest of the husband of the petitioner.”
Counsel for the petitioner submitted that for redressal of his grievance, petitioner has filed representation dated 26.10.2023 before respondent No 3, but no decision has been taken till date.
Lastly, it is submitted that a direction may be issued to respondent No 3 to decide the representation within a stipulated time.
Counsel for the respondents submitted that respondent No 3 is the competent authority to decide the matter and petitioner may be directed to file fresh representation before respondent No 3.
He further submitted that in case any such representation is filed, the same shall be considered and decided at the earliest.
In view of the facts and circumstances of the case, the Court disposed of the petition with liberty to petitioner to move fresh representation along with certified copy of this order before respondent No 3 within two weeks.
In case any such representation is filed, the Court directed the respondent No 3 to decide the same in accordance with law maximum within a period of four weeks thereafter.
