Allahabad High Court directs the director general of Medical education department to pay salary

The Allahabad High Court has directed the Director General of Medical Education Department to pay the outstanding salary within thirty days while deciding on providing the pay scale as per X-Ray Technician to the Radio Therapy Operator posted in the Medical College.

A Single Bench of Justice Ajit Kumar passed this order while hearing a petition filed by Sanjay Kumar Singh Rathour.

The Petitioner who is currently working as Radiotherapy Operator with the Principal of Sarojini Naidu Medical College and attached Hospital, Agra is praying for following relief as substantial relief:-

“(a) Issue a writ, order or direction in the nature of mandamus directing the respondents to fix the petitioner salary in the revised scale of pay of Rs 9300-34800 with pay grade 4200 and pay all arrears of salary w.e.f year 2013 i.e after completing his course Diploma in X-Ray Technician in the revised scale of pay with interest @ 12% per annum and other consequential benefits as per the G.O dated 08.09.2010.”

The Court noted that,

In the above regard, petitioner has already approached the authority vide representation dated 03.11.2015 upon which the Director General, Medical Education and Training, U.P Jawahar Bhavan, Lucknow had made some order on 15.01.2016 but the Principal, Medical College, Agra has not done anything further in the matter.

Matter is quite an old one. Accordingly, the Court provided that in the event petitioner makes fresh representation in the matter within four weeks from today regarding his claim as quoted hereinabove, the same may be directed to be disposed of by respondent no 2 by means of reasoned and speaking order within a further period of two months.

However, the Court clarified that in the event petitioner is held entitled to the relief claimed for, he shall be allowed to be paid the same within a further period of 30 days.

With the aforesaid observations and directions, the Court disposed of the petition.
