The Lucknow Bench of the Allahabad High Court has rejected the bail application of a man arrested for killing his wife, cutting her body into six pieces and throwing it in two bags in Safedabad area of Barabanki.
The Single-Judge Bench of Justice Dinesh Kumar Singh passed this order while hearing a Criminal Misc Bail Application filed by Sameer Khan.
The application under Section 439 CrPC has been filed seeking bail in FIR/ Case under Sections 302 and 201 IPC, Police Station Kotwali Nagar, District Barabanki.
In this case, the Accused-applicant is the husband/paramour of the deceased, whose body was found in two bags after being amputated and stuffed in two bags, which was thrown out in a secluded place.
Accused-applicant used to work in Mumbai and he met the deceased there and it appears that they started living as husband and wife.
Accused-applicant brought the deceased to Lucknow and took the house of Rizwan Haque and started living with the deceased.
Besides the confessional statement of the accused-applicant, on his pointing out, the car which was used for throwing the body of the deceased, was recovered.
The chopper, by which the deceased body was cut into pieces and stuffed in two bags, was also recovered on his way out. There are statements of witnesses on record, which would suggest that the accused-applicant and the deceased were living together.
“Considering the allegations, heinousness of offence and the evidence available on record, the Court does not find any ground to enlarge the accused-applicant on bail,” the Court observed while rejecting the bail application.
However, considering the fact that the accused-applicant has been in jail since 16.8.2020, the Court directed the trial court to expedite the proceedings and conclude the same, preferably, within a period of one year.
