Allahabad High Court provides no relief to SP MLA Irfan Solanki

SP MLA Irfan Solanki has not got relief from the Allahabad High Court. The Court has ordered his brother Rizwan Solanki’s bail application along with Irfan Solanki bail application to be presented for hearing on July 17.

A Single Bench of Justice Rajeev Misra passed this order while hearing a Criminal Misc Bail Application filed by Irfan Solanki.

The bail application of co-accused, Rizwan Solanki was also rejected, accordingly, he has also filed the repeat application for bail i.e Criminal Bail Application (Rizwan Solanki Vs.State of U.P).

The Court noted that,

For ready reference, the order dated 24.05.203 passed in the aforesaid Criminal Misc Bail Application is reproduced hereinunder:-

“The applicant has been in jail since 02.12.2022.

The trial judge, Kanpur Nagar shall forthwith send a report regarding the status of the trial and cause for the delay in concluding the trial in Case under Sections 436, 506, 147, 327, 427, 386, 504, 120B I.P.C Police Station Jajmau District Kanpur Nagar the following details in tabulated form:-

(1) Dates on which charge sheet was filed and the charge was framed.

(2) Number and particulars (i.e name, nature of witness like eye witness and expert witness etc) of prosecution witnesses proposed to be examined as per the charge sheet.

(3) Names and number of prosecution witnesses who have been examined before the trial court with dates.

(4) Names and number of witnesses who have been summoned but have not attended the trial proceedings on the appointed dates.

(5) Names and number of witnesses against whom coercive measures have been taken out with dates.

Put up this case on 17.07.2023 in the list of fresh cases.

A copy of this order be communicated to the trial judge through the District Judge, Kanpur Nagar by the Registrar (Compliance) by FAX.”

In view of the above, the hearing of the application is adjourned.

The Court has fixed the next hearing of the application on July 17, 2023.
