Allahabad High Court recalls order listing case of errant advocate before another bench

The Court stated that the senior members of the Bar and the President have requested us to recall the order though not requested by the counsel, who had misbehaved.

The Allahabad High Court has recently recalled its order in which it had directed the listing of a matter before another bench citing the “mischievous behaviour of the advocate”. 

Hearing a first appeal filed by Raja Ram, the Division Bench of Justice Kaushal Jayendra Thaker and Justice Subhash Chand said on September 6, while hearing these applications pending for long it had inquired from the advocate that the delay was condoned in all the matters, as all the matters were to be heard together. 

The Court said that then the Advocate had not addressed the Court properly and, therefore, we have passed the order of listing these matters before any other Bench. The Court stated that the senior members of the Bar and the President have requested us to recall the order though not requested by the counsel, who had misbehaved.

“While going through the record except F.A. No. 1028 of 1995, in no other matters delay condonation applications are allowed. Be that as it may, we recall the order dated September 06, 2021. List the matters on September 17, 2021 after giving a copy to the counsel, who has replaced Amit Manohar, Advocate. All the documents or the judgments that the counsel wants to rely may be filed in the Registry during this period,”

-the order reads.

Later, on September 17, 2021, the delay in filing of appeal was thereby condoned in First Appeal Nos. 190 of 1998, 267 of 1998 and 1028 of 1995.
