The Allahabad High Court has refused to pass an order to conduct elections for the student union of All India Institute of Medical Sciences (AIIMS) Gorakhpur.
A Single Bench of Justice Salil Kumar Rai passed this order while hearing a petition filed by Shashank Shekhar.
The petition has been filed praying for a mandamus commanding All India Institute of Medical Sciences, Gorakhpur to hold elections of the students union of the Institute.
The petitioner has the remedy to approach the Grievances Redressal Cell constituted in the University under Regulation-11 of the Medical College/Institution/University Regulations, 2009 framed by the National Medical Commission for the elections of students union.
For the aforesaid, the Court did not find it a fit case to issue mandamus at this stage under Article 226 of the Constitution of India.
“The petitioner may approach the Grievances Redressal Cell of the University and in case, the said Cell has not been constituted so far, the Institute shall immediately constitute the same in accordance with Regulation-11 of the Regulations, 2009 which shall consider the grievance of the petitioner”, the order reads.
With the aforesaid observations and directions, the Court disposed of the petition.
