The Allahabad High Court has stayed the transfer of constables working in Pradeshik Armed Constabulary (PAC) to Armed Police.
A Single Bench of Justice Rajiv Joshi passed this order while hearing a petition filed by Sunil Kumar Chauhan And 186 Others.
The writ petition has been filed challenging the order dated 7.5.2022 passed by the Additional Superintendent of Police, P.A.C headQuarter, U.P Lucknow so far it relates to the petitioners, whereby the petitioners have been transferred from the post of Constable, Pradeshik Armed Constabulary to Armed Police in various Zone / Commissionerate.
It is submitted by the counsel for the petitioners that the transfer of the constable can only be made within Pradeshik Armed Constabulary from one place to another place by the order of Pradeshik Armed Constabulary Establishment Board constituted by the State Government.

It is further submitted that the impugned order indicates that there is no order of any Board constituted by the State Government, even otherwise, transfer can only be made from one place to another within the P.A.C not outside the P.A.C i.e Armed Police.
“Standing counsel prays for and is granted two weeks time to seek instructions in the matter.
Till the next date of listing, the petitioners should not be compelled to be relieved pursuant to the impugned order”

The Court has fixed the next hearing of the petition on 30th May, 2022.
