The Lucknow bench of the Allahabad High Court has stayed the arrest of three accused persons in the suicide case of BJP leader Abhishek Shukla till further hearing.
Hearing a petition filed by Kashish Singh & Ors, the division bench of Justice Devendra Kumar Upadhyaya and Justice Narendra Kumar Johari stated, “Having regard to the overall facts and circumstances of the case, we hereby provide that the petitioners shall not be arrested in connection with aforesaid case crime number till the next date of listing.”
The petition has challenged the FIR dated October 25, 2021 lodged under Section 306 IPC at police station Sushant Golf City, district Lucknow Dakshini (Commissionerate Lucknow).
In this case, Abhishek Shukla committed suicide by shooting himself at Nandini Enclave in Sushant Golf City on October 25.
Digvijay Nath Dubey, counsel appearing for the petitioners submitted that the FIR was lodged by the father of the deceased at Sushant Golf City police station on October 25. The police have arrested Kumud Singh, the wife of the deceased in the case.
It has been further stated by the counsel for the petitioners that from a perusal of the First Information Report, no element of instigating the suicide appears to be made out.
The respondents have been asked to file their counter-affidavit within two weeks. “List this case after expiry of the aforesaid period. The petitioners shall cooperate with the investigation,” the Court ordered.
