The Allahabad High Court has stayed any coercive action against Krishna Sharan Agrahari @ Bablu of Mirzapur’s Haliya police station area on rape charges and has directed SP Mirzapur to appear on June 20 with an explanation.
A Single Bench of Justice Shekhar Kumar Yadav passed this order while hearing a Criminal Misc Anticipatory Bail Application filed by Krishna Sharan Agrahari @ Bablu.
The Court on 30.5.2023 has passed the following order:
“Vakalatnama filed today by Raghuvansh Misra, Advocate on behalf of the applicant is taken on record.
Supplementary affidavit filed today is also taken on record.
It is a very sorry state of affairs that despite several orders passed by the Court, instructions are not being obtained by the AGA within the stipulated time.
AGA is strictly directed to obtain instructions in this matter positively on or before the next date fixed in the matter.
Put up as fresh on 9.6.2023 before the appropriate Bench showing the name of Raghuvansh Misra, Advocate as counsel for the applicant.”
Despite the above order, neither A.G.A has obtained instruction nor filed any counter affidavit, the Court noted.
Under the circumstances, the Court directed the Superintendent of Police, Mirzapur to appear in person before the Court on 20.6.2023 to explain why the disciplinary action may not be taken against him.
On the request of the A.G.A, the Court directed to list the matter on 20.6.2023.
“Till the next date of listing no coercive action shall be taken against the applicant in Case under Sections 376, 452, 323, 504, 506 IPC, P.S. Haliya, District Mirzapur”, the Court ordered.
