The Allahabad High Court has stayed the hearing of the case on the petition seeking transfer of the acid attack case of Kaushambi.
A Single Bench of Justice Sanjay Kumar Pachori passed this order while hearing a transfer application filed by Raju Rai Sonkar.
The transfer application has been filed by the father of the victim of an offence punishable under Section 307, 352, 326- A/34/120B, 420A of IPC and Section 3(2) (v) of SC/ST Act.
It is submitted that the victim/injured was posted as a bank manager in city Kaushambi in Bank of Baroda. After the incident, the injured was transferred to city Prayagraj by the bank authority.
It is further submitted that there is a mere apprehension of danger to her life to lead evidence against the opposite parties no 2 to 8.
The Court granted two weeks time to file counter affidavits for the opposite parties and one week time to file a rejoinder affidavit for the applicant.
“Till the next date of listing, the proceedings of Sessions Trial No. 143 of 2022 (State Vs. Dilip Kumar and others) arising out of Case Crime No 191 of 2022, under Sections 307, 352, 326- A, 34/120B, 420 IPC and Section 3(2) (V) of SC/ST Act pending in the court of Special Judge, SC/ST Act, Kaushambi shall remain stayed”, the Court ordered.
The Court has fixed the next hearing of the petition on November 24, 2023.
