Allahabad High Court stops UP Sunni Central Waqf Board order, relief for Azam Khan

Prayagraj (ILNS): In what was a relief for the Maulana Mohd Ali Jauhar Trust, Rampur and its ‘mutwalli’ (the trustee) MP Mohd. Azam Khan, the Allahabad High Court on Thursday banned the implementation of the March 20, 2020 order of the Uttar Pradesh Sunni Central Waqf Board regarding encroachment and mismanagement.

At the same time, the Court has sought a reply from the state government in two weeks.

This order was given by a division bench of Justice Shashikant Gupta and Justice Pankaj Bhatia on a petition filed by the Trust. 

The Petition had sought the quashing of the Wakf Board’s order as it is against natural justice. The Petition states that the board does not have the right to interfere in the work of the trust unless there is strong evidence. It is a violation of Section 65 (5) of Wakf Act, 1995. The allegation of mismanagement on the mutwalli is baseless. 

The Petitioner was not given notice before the order was issued. In such cases the board does not have the right to take action.
