Allahabad High Court summons Banaras Hindu University VC on suspension of students

The Allahabad High Court has directed the Vice-Chancellor to appear before the court on April 24 for cooperation in the matter of suspended students of BHU Varanasi, due to lack of proper response from the university authorities.

A Single Bench of Justice Ajay Bhanot passed this order while hearing a petition filed by Vineet Mishra.

The Court said that the suspension period of the petitioner is getting over on 20.04.2023. As an interim measure, the petitioner shall be permitted to appear in the VI Semester examination in BA (Honours), Geography which are scheduled to commence on 20.04.2023. The result shall not be declared without leave of the Court.

On the issue, Hem Pratap Singh, counsel for the respondent – University submitted that the process of alternative and a reformative approach of deviant student behaviour is under active consideration of the University.

The Court further said that,

The Court prima facie is not satisfied with the response of the University. The judgment was passed with the consent of the University on 02.12.2019 in Anant Narayan Mishra vs Union of India and 4 others reported at 2020 (3) ADJ 466. The stakes are too high for any apathy on the part of the University.

Considering the fact that a number of matters pertaining to deviant student behaviour are engaging the attention of the Court and a proper response from the University as well as other authorities is not forthcoming, in the interest of justice, the presence of the Vice-Chancellor is requested to assist the Court in this matter of vital significance to the future of young students and indeed the nation.

The Court has fixed the next hearing of the petition on April 24, 2023.
