New Delhi (ILNS): The Allahabad High Court will hear tomorrow the government’s response in the habeas corpus petition filed by two Nigerian nationals who have alleged that they have been illegally detained. On November 10 the court had asked the counsel for the Union of India and the state’s Advocate General to seek instructions in the matter within three days.
The bench of Justices Ramesh Sinha and Samit Gopal heard the petition under Article 226 of the Indian Constitution filed by petitioners Chinasa Victor Obioha and Chima Paul Ugochukwu, filed through their friends and wives.
The petition stated that the two petitioners have been under illegal detention at Surajpur Police lines, 49 Batallia, Greater Noida, Uttar Pradesh since September 24, 2019 and had sought their immediate release.
Moreover, a direction to the Centre was also sought for the sympathetic consideration of their application for grant of long term visa as per the internal guidelines of the Ministry of Home Affairs.
Advocate Anurag Ojha, representing the detenus, told the court that they have not even been produced before a magistrate till date.
