Andhra Pradesh HC stops Hospital Auction, says use it for Corona Victims

Andhra Pradesh High Court on Tuesday ordered to reopen Hospital for treatment of Coronavirus with assistance of doctors working there and by using medical facilities available, including medical equipment and paramedical staff.

The order for reopening was given by Chief Justice J.K. Maheshwari and Js. M. Satyanarayana Murthy in a writ petition filed seeking various reliefs in relation to seizure of Purna Sai Hospitals, Guntur, and its proposed auction in pursuance of the proceedings initiated by the respondent bank i.e., Syndicate Bank under the provisions of the Securitisation and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002.

During the course of hearing held through video conference, learned counsel for the petitioners voluntarily requested that instead of closure of the hospital, medical facilities and the staff available in the hospital may be utilised in view of the medical emergency arose in the State on account of Novel Covid-19 (corona virus) pandemic and the patients may be treated in the hospital by using the staff and equipment so available in the hospital.

Learned Advocate General reported no objection for utilisation of the said hospital for the purpose of providing treatment to Novel Covid-19 patients.

Considering the aforesaid, while adjourning the hearing of the case for a period of three weeks, the Court observed that the subject hospital be re- opened, staying the order dated 20.11.2019 passed by the Chief Judicial Magistrate-cum-Principal Assistant Sessions Judge, Guntur, and the patients with Novel Covid-19 (corona virus) may be treated in the subject hospital with the assistance of the doctors working therein, by using the medical facilities available, including equipment and paramedical staff, till further orders. It was made clear that the hospital be utilised only by the Government for the patients of Novel Covid-19 (corona virus) only.

The matter is to be listed for further orders after three weeks.
