Andhra Pradesh High Court quashes allotment of 2,866 acres of reserved forest land for flats in Nellore district

The Andhra Pradesh High Court has quashed the allotment of 2866 acres of reserved forest land for a housing project in SPSR Nellore district.

The land, notified as a reserve forest since 1890, was allotted by the Tahsildar in July 2023 without obtaining necessary sanctions.

Reasons for Quashing:-

– Violation of Board of Revenue Standing Orders

– Lack of special sanction from Collector

– No consent from Conservator of Forests

The Division Bench of Chief Justice Dhiraj Singh Thakur and Justice Ravi Cheemalapati deemed the Tahsildar’s action unsustainable and reverted the land to the Forest Department for preservation as a forest area.

The petition, filed in public interest, highlighted the illegal allotment and sought cancellation.

The Forest Department confirmed the land’s reserved status and lack of consent.
