The Andhra Pradesh High Court closed a Public Interest Litigation (PIL) filed highlighting the encroachments made by some private respondents over Government land.
The PIL has been filed by one Potta Siva Prasad .
The Division Bench of Chief Justice Dhiraj Singh Thakur and Justice R. Raghunandan Rao noted that even prior to the institution of the present PIL, action was taken by the Mandal Revenue Officer and orders of eviction have been passed.
According to the counter affidavit filed by the District Collector, YSR District, certain appeals are also filed against the orders passed by the Mandal Revenue Officer, which are pending ever since.
Be that as it may, the Bench directed that in cases where no appeals had been filed and the period of limitation had already expired, it would be open to the official respondents to evict the encroachers. In such of the cases where appeals are already filed and pending with the Revenue Divisional Officer, the appeals be decided positively within a period of two months. Based upon the outcome of the appeals so filed, the action would be taken by the Mandal Revenue Officer.
