Delhi High Court directs BCCI to decide on transfer plea of cricketer to DDCA

The Delhi High Court on Monday directed the Board of Control for Cricket in India (BCCI) to decide on the transfer petition of a 19-year-old cricketer from Haryana Cricket Association to the Under-19 team for Delhi and District Cricket Association within two days.

A Single Judge Bench of Justice Rekha Palli disposed of the petition filed by Neel Chikara, after the Counsel for BCCI that the petitioner’s representation will be decided within two days.

Advocate Harish Vaidyanathan Shankar, appearing on behalf of Chikara, informed the court that the petitioner had already missed out on the white ball tournament and if the transfer is not immediately sanctioned, he would miss out on the red ball tournament as well.

Advocate Bina Madhavan, appearing for BCCI, submitted that it has accepted the petitioner’s proof of residence and the transfer would be decided within two days.

On September 27, BCCI had submitted that Neel’s application has not been rejected on the ground of not furnishing an identify proof, but the petitioner, who was called for physical tests conducted on August 28 for the Under 19 category, could not be selected on merit.

In response, the Counsel appearing for Neel, while agreeing that physical tests did take place on August 28, sought to contend that the petitioner was selected on merit, but his name was rejected by BCCI as the NOC available with the petitioner was not accompanied by any acceptable proof of identity.

Due to the divergent stands taken by Chikara and BCCI, the court had directed both parties to file affidavits, accompanied by copies of necessary record.
