Bombay HC notice on PIL alleging Goa not following SC directions to probe violations of mineral concession rules

The Bombay High Court Bench in Goa has recently issued notice on a PIL alleging that the State of Goa  has not carried out directions issued by the Supreme Court to conduct inquiries into violations of Rule 37 of the Mineral Concession Rules, 1960.

The PIL has been filed by environmental action group The Goa Foundation through its Secretary Dr. Claude Alvares.

Norma Alvares, advocate for the petitioner, submitted  that although the said directions were issued by the Apex Court in its judgment dated April 21, 2014, however, despite passage of seven years, no action has been taken by the Government of Goa.

She further submitted that apart from the reliefs sought in the PIL, the Goa Government be directed to produce the list of leases, where there is prima facie evidence of violation of Rule 37 of the Mineral Concession Rules.

While considering the PIL, the Division Bench of Justice Revati Mohite Dere and Justice M.S.Jawalkar issued notice to the respondents and posted the matter on December 21 for further hearing.
