The Bombay High Court disposed of a Public Interest Litigation related to the death of a lady in suspicious circumstances.
The petitioner had initiated the PIL in view of the newspaper report indicating that in spite of a lady having died in suspicious circumstances the police machinery was not taking the incident seriously and was brushing it under the carpet by attributing it as a suicide.
The Aurangabad Division Bench of Justice Mangesh S. Patil and Justice Y.G. Khobragade heard the petitioner in person and the public prosecutor and perused the charge sheet.
Irrespective of the allegations, during the pendency of the PIL the investigation has been undertaken and the chemical report was also obtained and in due course of time, a charge sheet has been filed for the offences punishable under Section 302, 306, 354, 376(a) (d) read with Section 34 of the I.P.C. Ex facie going by the transcript of the audio conversation which the deceased apparently had with her cousin whose statement under Section 164 of the Cr.P.C. has been recorded as also the statement of eye witness child recorded under Section 161 as well as 164, the purpose of filing petition, in view of the Court has been fulfilled.
Let the trial court now ponder upon and decide it expeditiously, the Court observed.
