Bombay High Court stays further construction at Erangal Beach, directs authorities to survey if construction violates CRZ rules

From the photographs, the Court noted that the offending structure, construction of which appears to be in progress, is on the beach and prima facie contrary to Coastal Regulation Zone Notification dated 6 January 2011 as modified from time to time.

The Bombay High Court has recently stayed further construction at Erangal beach while hearing a PIL. The Division Bench of Justice A.A. Sayed and Justice A.L. Pansare heard the PIL filed by Chetan Kodarlal Vyas, which relates to construction at Erangal beach, situated at  Erangal village, Malad (West), Mumbai.

From the photographs , the Court noted that the offending structure, construction of which appears to be in progress, is on the beach and prima facie contrary to Coastal Regulation Zone Notification dated 6 January 2011 as modified from time to time.

Therefore, the Court directed the concerned authorities to nominate an Officer from their Departments, who will jointly carry out a survey of the offending structure and file a Report in the High  Court by the next date.

The joint survey shall be carried out on October 27 at 11 am. The Bench clarified that in the event it is found that the construction is illegal, appropriate action will be taken by the Respondent-Authorities forthwith. “Until the next date there shall be a stay on further construction.”

The Court has listed the PIL for November 17.
