The Gauhati High Court directed the Deputy Commissioner, Cachar to consider the grievance of the petitioner related to the irregularities in the functioning of the President and the Secretary of the Fulbari Gaon Panchayat.
The Division Bench of Chief Justice Sandeep Mehta and Justice Suman Shyam disposed of a Public Interest Litigation (PIL) filed by one Ali Ahmed Mazumder alleging the same.
It is noted by the Court that the petitioner had earlier submitted a representation dated 27.10.2017 before the Deputy Commissioner, Cachar District.
However, as no action has been taken on the said representation, the petition has been filed.
After going through the materials available on record, the Court is of the view that the allegations made by the petitioner would call for a fact-finding inquiry.
The Court held the Deputy Commissioner of the district would be in a better position to make such an inquiry so as to verify the correctness of the allegations brought by the petitioner.
“As such, we dispose of this PIL by directing the Deputy Commissioner, Cachar to consider the grievance of the petitioner ventilated in the representation dated 27.10.2017 and dispose of the same by a speaking order within three months of the receipt of a certified copy of this order. If the petitioner continues to remain aggrieved even thereafter, it will be open for him to seek appropriate remedy as per law. This writ petition stands disposed of,” reads the order.
