Calcutta HC Extends All Interim Orders Till September 30

The Calcutta High Court has extended the duration of all interim orders passed by the High Court and subordinate courts in the State till September 30, in wake of the current pandemic. 

The order was passed on Tuesday by a Bench comprising of Chief Justice Thottathil B Radhakrishnan, Sanjib Banerjee, IP Mukerji, Harish Tandon and Joymalya Bagchi. The Court took suo motu action regarding the matters pending with interim orders in High Court of Calcutta and the Courts that are subordinate to it. 

The order has extended the application of its earlier orders of extension of interim orders till September 30. 

The Court post the pandemic lockdown had for the first time extended the application of its interim orders on March 24th. This was followed by extension the applicability of these orders till June 30.

However, now since the pandemic is still continuing the Court has further extended these interim orders till September 30. 

“The order issued on 24th March, 2020 and corrected by later order of even date and extended till 30th June, 2020 by order dated 23rd April, 2020 will stand extended till 30th September, 2020 or until further orders of Court, unless specifically dealt with by any judicial order to the contrary,” the latest order reads. 

The Court has also clarified that if any parties are aggrieved by such extension they can apply to the appropriate court to vacate or vary such extended interim orders.
