The Calcutta High Court has held that a writ court should not interfere in technical matters, more particularly with regard to the width of a bridge or width of a road which are to be left to the decision of the experts.
The Division Bench of Chief Justice T.S. Sivagnanam and Justice Ajay Kumar Gupta disposed of a Public Interest Litigation (PIL) filed seeking construction of two bridges at Lalpul and Dasmile.
The petitioners along with the other villagers are sought to have been made by a common representation to the respondent authorities in respect of the proposed construction of two bridges at Lalpul and Dasmile with a request to construct the bridges and maximum width according to the National Highway Rules so that there will be a smooth movement of the vehicle as well as use of the public on the footpath on the bridge.
In this regard a representation has been made to the authorities.
“Time and again it has been held that a writ court should not interfere in technical matters, more particularly with regard to the width of a bridge or width of a road which are to be left to the decision of the experts and in the instant case the National Highway Authority is the proper authority to deal with this.”
Therefore, at this juncture, the Bench declined to issue any direction as sought for. However, the Court gave liberty to the petitioners to pursue their representation before the appropriate respondent, which shall be considered in accordance with law.
