Case of death of NLU student needs to be re-examined, says SC

New Delhi: The Supreme Court has said that the case of the death of a third-year law student at National Law University (NLU) in Jodhpur in 2017 needs to be re-examined.

A three-judge bench of Justices R.F. Nariman, Navin Sinha and Indira Banerjee completed the hearing of the plea of the deceased student’s mother through a video conference, and then said: “We can direct its re-investigation. This is not the way.” Earlier, the bench had looked at the Rajasthan Police report on the investigation of the case.

The bench said in its order that the argument was heard, but the decision will be pronounced later. During the hearing, advocate Sunil Fernandes on behalf of the deceased student’s mother said that no progress has been made in the investigation of the case. The mother of the deceased student has requested the court to hand over the investigation to the Central Bureau of Investigation.

Senior Advocate Manish Singhvi, on behalf of the government of Rajasthan, said that the police will re-examine it as directed by the court.

The apex court had said in July that after completing this inquiry in two months, the report should be presented before it. Neetu Kumar Nagaich, mother of law student Vikrant Nagaich, has requested the court to direct the CBI to take all steps to solve the mystery of the unnatural death of his son. The petition states that an FIR was registered in the case in June 2018 after about 10 months.

The petition alleges that the case is being investigated in a manner that suggests that efforts are on to save an influential person. According to the petition, despite three years having passed, the police have not yet filed a charge sheet. The investigation is at a standstill and no attempt has been made to arrest the culprits.

The petition stated that Vikrant had gone with his friends to a restaurant about 300 meters away from the university campus on the evening of August 13, 2017, but he did not return from there and the body was found near the railway line the next day. The mother of the deceased alleges that the police neither contacted Google or Facebook nor tried to get the data of her mobile phone, which could be helpful in determining the time of her arrival
