The Chhattisgarh High Court has dismissed a public interest litigation (PIL) challenging the construction of a railway siding project by Clean Coal Enterprises Private Limited in Akaltara, Janjgir-Champa district.
The project, initiated in 2016, had completed nearly 95% of the work when the PIL was filed on April 9, 2024.
The petitioners alleged that the project lacked necessary permissions and violated regulations.
The Division Bench of Chief Justice Ramesh Sinha and Justice Bibhu Datta Guru deemed the petition devoid of merit, citing the petitioners’ failure to counter a complaint filed by the respondent against one for threatening to stop work.
Additionally, the court noted the eight-year delay in filing the petition and the lack of plausible explanation for the delay.
The respondent argued that all necessary permissions had been obtained, including a ‘No Objection Certificate’ from the relevant authorities.
