The Chhattisgarh High Court dismissed a Public Interest Litigation (PIL) filed seeking direction to the respondent authorities to made expert team for enquire the construction of the swimming pool, experience certificate of the agency, cost incurred in preparation, standard of used material and the other norms according to the international swimming pool.
B.P. Singh, Advocate for the petitioner submits that the inaction on the part of the respondent/authority is not examining the quality and standard of the swimming pool as well as the experience certificate of the construction agency is against the public policy and thus, judicial interference is required.
He further submits that the condition of the tender notice especially the experience certificate of the construction agency is not followed and thus, it is the duty of the respondent authorities to enquire the experience certificate of the agency but the same is not acted upon in this matter and because of the negligence of the respondent authorities, public life can’t be put up in their hands and on their own choice.
It is further submitted that the money involved in this matter are collected from general public by the respondent authority and thus the petitioner has raised all questions for the purpose of saving the life and fund of public but till date the respondent authorities are so adamant that they have not yet completed a team of experts to enquire about the construction, quality and other safety measures for the safety of the public. Therefore, direction may be issued to respondent authorities to constitute an expert team to enquire about the construction of the swimming pool, experience certificate of the agency, cost incurred in preparation, standard of used material and the other norms applicable to the international swimming pool.
The state counsel submits that in the subject-matter, tenders were invited on 19.11.2015 for construction of a swimming pool at International Hockey Stadium, Rajnanadgaon and construction work is now completed and this petition is filed after the lapse of so many years. Therefore, this petition is liable to be dismissed.
The Division Bench of Chief Justice Ramesh Sinha and Justice Rajani Dubey noted from all the documents that for construction of swimming pool, tenders were invited on 19.11.2015, construction work is completed and petitioner has filed several complaints before several authorities for enquiring about the construction work and he objected that agency was not having proper work and experience certificate. One petition was also filed in this matter and the same was dismissed on 28.09.2016. The petitioner filed this petition with an inordinate delay because the delay is not properly explained by the petitioner.
