The Chhattisgarh High Court has stayed the Kondagaon district collector’s order cancelling the election of the Keshkal Nagar Panchayat councillor.
On Thursday, a single bench of Justice P.P. Sahu’s vacation court stayed the order which voided the election of the petitioner, Sagir Khan, who had moved the High Court through his lawyer Rajesh Kesharwani.
It was stated that the petitioner has been a four-time councillor from the Congress in Keshkal Nagar Panchayat. This time, he contested as an independent candidate and won. He had informed in his nomination letter that he was sentenced to two years and later acquitted.
Even after this, the opposition candidate complained about contesting against him even after being convicted to the Collector, and demanded to cancel the election. During the last hearing, the High Court prohibited the collector from issuing any order against the petitioner.
The petitioner alleges that even after the Court order, the collector issued the order on the last date due to political pressure and declared his election void.
It is also mentioned in the petition that under the Sections in which the Collector has taken action, he does not have the right. The Election Commission has the right to void election. However, the Collector has issued an order, misusing his jurisdiction, claimed the petition.
