The Chhattisgarh High Court has dismissed a PIL related to the construction of a temple situated at village Bhulsi Kala, District Balrampur-Ramanujganj, which is recorded as “Bade Chhote Jhad ka Jungle”.
Petitioner Sushil Ekka, along with some villagers, had submitted representations on July 5 and 7, 2022 to:
(i) Secretary Revenue
(ii) Collector, Balrampur-Ramanujganj
(iii) Sub-Divisional Officer, Kusmi, and
(iv) Tehsildar, Kusmi.
However, the representations had not been considered.
Astha Shukla, Government Advocate, submitted that a proceeding was initiated under Section 145 of Cr.P.C. by one John Ekka against Larang Sai Paikra, Greece Kanwar and Doyel Taya Ram Kanwar in respect of the same land and the Sub-Divisional Officer had dismissed the application by an order dated July 6, 2022, wherein it was recorded that the temple was in existence for last 100 years and only renovation work has been done.
On due consideration, the Division Bench of Chief Justice Arup Kumar Goswami and Justice Deepak Kumar Tiwari declined to entertain the PIL and asked the petitioner to seek remedy in accordance with law.
