The Chhattisgarh High Court consigned to record a Public Interest Litigation (PIL) filed seeking direction to the respondent Central Government to constitute the flying scoot committee for surprise
inspection of the physicians, doctors and Hospitals and ensuring strict compliance of the guidelines.
The PIL further prayed :-
-to direct the Respondents and other Government agencies to procure Generic Medicines for their usage instead of branded medicines as far as possible.

to direct the Respondent Union of India to ensure that payment under Ayushman Bharat scheme is made for usage of generic medicine in treatment in public as well as private hospitals.
It has been pointed out by the counsel for the parties that the matter pertaining to the present subject matter is subjudice before the Supreme Court in the matter of Kishan Chand Jain v. Ethics
& Medical Registration Board & Others .
It has further been pointed out by R.S.Marhas, counsel for the National Medical Commission that vide notification dated 23rd August, 2023, the National Medical Commission Registered Medical Practitioner (Professional Conduct) Regulations, 2023, have been held in abeyance with immediate effect and as such, this petition has been rendered infructuous.
The Division Bench of Chief Justice Ramesh Sinha and Justice Ravindra Kumar Agrawal held that as the matter is already subjudice before the Apex
Court, it would not be appropriate for the Court to proceed further in this matter and accordingly, the present petition is consigned to record by the High Court.
