Delhi Court convicted Assembly Speaker Ram Niwas Goel for trespass

On Friday, a Delhi Court convicted Delhi Legislative Assembly Speaker Ram Niwas Goel and his son Sumit Goel along with few others for the offence under Section 448 IPC and 323 IPC.

The Prosecution /Complainant stated that Mr. Ram Niwas Goel along with few other people entered into his house climbing through front and back walls. The Complainant further alleged that the accused damaged the property and broke almirah and kitchen articles.

Mr. Manish Ghai, the complainant recorded the statement that he was rushed to his house after getting call from his driver and found Mr. Ram Niwas Goel on the spot who was one of the person present on the site. Although, he denied that Mr. Goel broke anything before his eyesight. The Court extensively recorded the statement of the formal witness including the SDM and Police official who put the statement testifying the house-trespassing.

One of the Witnesses of the Accused deposed that the place of the complainant was getting used to distribute liquor and on the information, the same action of leading towards the house was taken by the accused along with the officer from election commissioner.

Learned Metropolitan Magistrate, Samar Vishal while concluding the statements found that the case of house trespass has been established by the prosecution while other charges were dropped against the Ram Niwas Goel. However, the son of Mr. Ram Niwas Goel, Mr. Sumit Goel was additionally charged under section 323 IPC apart from section 448.

The Court while convicting the accused deferred the matter for argument on sentence on 18.10.2019.
